NICWER complies with the Privacy Act 1998 (Cth) and NICWER deals with personal information in accordance with the National Privacy Principles.

Collecting information

NICWER offers an online search registry service concerning the ownership, transfer and management of water entitlements. If your water entitlements are available on this service NICWER was provided by the Irrigation Corporation that issued you with your water entitlement with details of:

• your entitlement number;
• your entitlement issue;
• your entitlement class;
• your certificate number;
• your entitlement amount;
• your name and the details of the other registered entitlement holders;
• encumbrances on the entitlement; and
• notices of permanent trades in progress.

That Irrigation Corporation has advised NICWER it has your approval to use your personal information as part of the NICWER service. If you have not approved use for this purpose of your personal information, then the Irrigation Corporation can not provide the information to NICWER and your entitlement can not be included as part of the online search registry service.

If you require the service NICWER offers we will collect personal information about you when you request a search by completing the online transaction form. Giving us your information is optional but without it, we may not be able to give you access to our services.

We will collect the following information from you if you complete a transaction on this website:

• the IP (Internet Protocol) address of the machine used to access the information;
• your top level internet domain name (eg .com, .gov, .au etc);
• the address of your server;
• the date and time of your visit;
• the pages accessed and downloaded; and
• your name, company, email address and what you searched for.

We will store your contact information.

Use and disclosure of personal information

Personal Information will only be used for the purpose of the online search registry service which NICWER provides. At no time will we sell or provide your information to a third party for marketing purposes.

Exceptions

NICWER reserves the right to gather more extensive information than stated above and to make disclosures to appropriate authorities in circumstances where there:

• appears to be unauthorised attempts to index, tamper with or otherwise interfere with files published on the site;
• appears to be unauthorised attempts to access files which are not published on the site;
• are attempts to intercept messages or otherwise interfere with the enjoyment of this site by other users; or
• are attempts to compromise the security of the web server or to breach the laws of any state or territory or the Commonwealth of Australia.

Technology

The internet works by automatically transmitting some non-personal information about your IP address, web browser and computer operating system. We will use this information for demographic purposes and to determine the level of usage of the available features on the website, helping us to continually improve it. After the data is analysed, it is not kept.

Service Providers

NICWER may use service providers in the process of collecting, using or disclosing personal information and if it does so the service providers will be obliged to comply with this policy in how they handle personal information.

Future Communications

You may be contacted by NICWER if you have an outstanding request for service or if you make an inquiry on our online helpdesk, the information you provide may be forwarded to personnel within, authorised or contracted by NICWER who can assist with your questions. The information will be used only to respond to the query made and a record of the communication will be retained for seven (7) years for business purposes.

Statistical information, such as the number of inquiries and query response times, may also be aggregated from time to time for business purposes. All personal and sensitive information will be removed and not stored.

Protected /Security

We take reasonable steps to protect the personal information we hold from misuse, use, loss, unauthorised access, modification and/or disclosure. No information transmitted over the internet can be guaranteed to be 100% secure. Where information is stored in paper form, it will be maintained by personnel within, authorised or contracted by NICWER.

Access to Personal Information held by NICWER

You have a right to request access to any information held by NICWER which relates to you. You also have the right to request the correction of any information which relates to you and is inaccurate. Any corrections should be advised to NICWER in writing. Any requests for access to personal information should be made to NICWER in writing.

If your water entitlements are available on this service NICWER was provided with the relevant details, which includes personal information, from the Irrigation Corporation which issued you with your water entitlement. If this information is incorrect you must contact the relevant Irrigation Corporation that issued you with your water entitlement. If you make an enquiry of NICWER concerning this matter we will forward that enquiry to the relevant Irrigation Corporation.
